1. Introduction
This Messaging & Consent Responsibility Policy defines the legal responsibilities of customers (“you”, “your”, “the business”) when using GoDigital2Achieve Ltd (“GoDitach”) services to send emails, SMS, WhatsApp messages, review requests, and automated communications.
This Policy applies to all GoDitach platforms, including Starring, ScalePro, and any subdomain-based services.
The English version is the legally binding version.
2. Customer as the Data Controller
For all messaging activity, the customer is the Data Controller.
This means:
• you determine the purpose of every message
• you determine the legal basis for sending messages
• you decide the content, timing, and recipients
• you are responsible for obtaining valid consent from your contacts
• you must comply with GDPR, UK-DPA, CCPA, KVKK, CAN-SPAM, and WhatsApp/SMS/email rules
GoDitach acts only as a technical service provider (Data Processor).
3. Consent Requirements
You must ensure that all contacts imported into the system:
• have explicitly agreed to receive communication
• have provided consent in a lawful, verifiable manner
• can withdraw consent easily (unsubscribe/opt-out)
• are not obtained from purchased or scraped lists
• are not contacted for purposes beyond their consent scope
Failure to comply may result in message blocking, account suspension, or legal consequences depending on jurisdiction.
4. Automated Messaging Responsibilities
Automated messaging includes:
• review requests
• appointment reminders
• WhatsApp follow-ups
• email sequences
• SMS notifications
• chatbot flows
• feedback collection
For all automated flows:
• the business decides what is sent
• the business configures triggers
• the business uploads contact lists
• the business approves templates
• GoDitach does not initiate communication independently
GoDitach is not responsible for the customer’s message content, accuracy, or legality.
5. Review Management Responsibilities
When using Starring or similar features:
• you may request reviews from your own customers
• you may collect internal low-star feedback privately
• you may not incentivize or manipulate reviews
• you may not pressure customers to alter their opinions
• you must follow Google’s and other platforms’ review guidelines
GoDitach does not monitor or validate review requests.
6. Prohibited Messaging Practices
The following are not allowed:
• unsolicited mass messaging to non-consenting users
• spam, bulk advertising, or cold outreach without a legal basis
• misleading, deceptive, or impersonated communication
• using the platform to harass or threaten individuals
• uploading data without user consent
Violations may result in suspension and reporting to relevant authorities.
7. Role of GoDitach
GoDitach provides:
• the platform
• the automation tools
• technical processing
• secure delivery infrastructure
GoDitach does not:
• supply contact lists
• verify the legality of your lists
• write or approve your message content
• determine your legal basis for communication
• initiate messaging without your configuration
This ensures that legal responsibility remains with the customer, as required under international data protection laws.
8. Liability
The customer is fully responsible for:
• all messages sent using GoDitach services
• compliance with all applicable laws
• any damages, penalties, or complaints arising from their messaging practices
GoDitach is not liable for customer misuse of the platform.
9. Updates
GoDitach may update this Policy as required.
Continued use of our services indicates acceptance of the latest version.
